End of Year

I apologize for not posting over the past weeks.  The end of year flurry of business has been heavier than usual.  Of course, I am not complaining!

Price Increase Coming

The current investment of $287 (plus $8 S&H) will be considered a "bargain basement" price within the next few weeks as the new price will soon be set at $587 (plus $8 S&H).

Not a Record, But Still Pretty Quick

A client retained my services to settle a default judgment that was pending on Thursday, August 20th.

Primarily due to great lines of communication with the creditor's attorney and fast responses to offers & counter offers, I closed settlement negotiations today... only one week from the start.

On a pending judgment with a principal claim of $31,000, attorney's fees of $3,000 and a few hundred dollars in court costs, I convinced the creditor to accept only $15,000 total.  Payments are set for 30 monthly installments of $500 each at 0% annual interest.  Plus, the judgment will not be pursued, filed or enforced.

You probably know the rest of the story... my client is thrilled with the savings, the creditor will receive money they may never have seen and I earned a fair fee for my efforts.  All parties benefitted.

An $1,800 Fee in 5 Days

I never know exactly what to expect going into settlement negotiations with a creditor and attorney with whom I have not previously dealt.  They may refuse to compromise at all on a debt, they may take weeks or even months to finalize a settlement or they may move very rapidly.

A case I settled last week was a surprise combination of a refusal to compromise that turned into a quick discounted settlement... resulting in an $1,800 fee.

I had emailed a prospective client offering my assistance with a recent lawsuit where his company was named as the defendant.  Once he was served, he contacted me.  After discussing the background on the claim, I set my fee and obtained some preferred payment guidelines from my new client.  I then quickly emailed the creditor's attorney and opened negotiations with a fairly low settlement offer on a long term payment plan.  The offer was almost immediately rejected outright and the attorney reiterated the demand for payment in full plus over $5,300 for attorney's fees and back interest.  She also provided a very short term payment plan that she had previously offered to my client.

So I called her to discuss this and explain my client's difficult financial situation.  She still refused to budge and it was time to play hard-ball.

My next email contained an increased offer (still at a discount) on a monthly payment plan.  But, in this communication, I made it clear this was a final offer and I reminded her that her client would be "rolling the dice" if they decided to pursue a judgment for the full amount.  Her quick reply was an acceptance of the offer.

All of this occurred from Monday to Friday of last week.

Again, I did not know going into negotiations whether this would take 3 days or 3 months.  In the end, (and as usual) all partied benefitted,

Even MORE Repeat Business

Here is another example of how repeat business plays a BIG role in this profession...

A client first retained my services when I contacted him about a lawsuit in early February of this year.  As I was working that case, I saw that another case had been filed against this same client in another completely different county and jurisdiction.  Oddly enough, the same attorney was representing this new plaintiff (creditor) and my client hired me to settle this case as well.

Both cases were resolved to my client's complete satisfaction within a few short weeks each (and both generated a nice fee for my successful results).

Today, this client called me with ANOTHER case for me to work and indicated he will also have one more very soon.

The point is, if a company has one problem debt, chances are they have OTHERS.  One successful settlement often leads to more cases (and fees) with the same client.

A Quick Settlement

I have mentioned on previous occasions that this can be a pretty fast process.  Here's another example...

After a couple of phone conversations, my services were retained by a new client on Monday, March 9th to settle a pending lawsuit.  After consulting with my client about his preferred payment guidelines, I emailed an offer to the creditor's attorney that same day.

Today, March 12th, just 3 days later, I received an email from the attorney indicating his client accepted the offer.  He is now preparing the settlement documents.  I am sending details of the settlement to my client along with an invoice for my fee.

As always, ALL parties benefited.  My client is resolving this matter to his satisfaction (with better payment terms than he asked for), the creditor will be receiving money without further expense and effort and I earned a nice fee for my expertise.

Not all cases close this quickly but cases tied to pending lawsuits typically move fast.

The Most Poular New Business

A recent article listed the top 10 most popular businesses for entrepreneurs to start.  The top spot went to Services.

It's a no-brainer that Services tops the list, says Sabrina Parsons, Palo Alto Software CEO. "It's always the top one because you can be a one-person business," she explains. "If someone has the skills they are the easiest to start because they're usually not capital-intensive. You probably don't need a bank loan or other financing."
